417.1 POLICY**

A safe and secure environment is fundamental to fulfilling CEI’s mission. CEI is committed to maintaining an environment free of violence. This obligation includes restricting recognized hazards from the campus community that contribute to violence or serious harm.

Accordingly, the possession, wearing, carrying, transporting, or use of a Weapon, except pursuant to an exemption expressly stated in adopted procedures, is strictly prohibited on College-owned or controlled premises. This prohibition extends to any person with a government-issued permit or license, unless specifically covered by an exception to the prohibition.

Violation of this policy may result in disciplinary action and the following sanctions:

  • Exclusion or expulsion, in the case of students; or
  • Exclusion or dismissal from employment, in the case of faculty and staff; or
  • Exclusion from campus, in the case of the public; or
  • Prosecution under appropriate local, state or federal laws

417.2 DEFINITIONS

Weapons: Any animate or inanimate device, instrument, material, or substance used for, or is readily capable of, causing death or serious bodily injury. Any device that is deadly or dangerous as well as replicas or facsimiles that may be perceived as a weapon. Includes firearms, knives, incendiary devices and explosives.

College-owned or controlled premises: Properties owned or controlled by the College include all CEI owned or leased buildings and surrounding areas such as sidewalks, driveways, and parking lots. This policy applies to CEI employees or students who may be off CEI property who are performing an activity for CEI including recreation and intercollegiate events, conferences, or meetings.

417.3 PROCEDURES

The following are exceptions to the general prohibition of weapons on college-owned or controlled premises:

  1. The lawful possession of weapons by full-time sworn peace officers, Level I reserve officers, and qualified law enforcement officers, as such officers are defined in 18 U.S.C. Sec. 926B (whether in uniform or off-duty/plain clothes with proper identification). Also included in this exception are on-duty armored transport personnel.
  2. The lawful carrying of concealed firearms by a qualified retired law enforcement officer, as such officers are defined in 18 U.S.C. Sec. 926C and Idaho Code Sec. 18-3302H.
  3. The lawful carrying of concealed firearms by a person who holds an enhanced license to carry concealed weapons, as described in Idaho Code Sec. 18-3302K. a. However, it is not lawful for a person issued a license under the provisions of Idaho Code Sec. 18-3302H or Idaho Code Sec. 18-3302K to carry a firearm under the influence of alcohol.
  4. Personal protection taser (“stun gun”), or pepper spray, i.e., Oleoresin Capsicum or OC, may be carried on campus
  5. Leatherman-type device or pocket knife, with a blade of less than 2 ½ inches in length.
  6. Household knives intended to be used for, and actually used for, the express purpose of cooking and eating.
  7. Prior specific, written permission may be obtained from the CEI vice-president of finance and administration to bring any weapon on campus for certain activities or legitimate purposes e.g., class projects or demonstrations, or displays of antique firearms or art objects.
  8. Some students or instructors regularly use tools which fall under the definition of weapons. Such tools, when under the supervision and control of authorized staff or faculty and when applied directly to a legitimate use in College programs, are exempt from this policy.

CEI may conduct weapons screening to meet the requirements of this policy. Screening procedures will be determined on available security intelligence, threat indicators, attendance, crowd control needs, and specific event contract requirements. Screening procedures may include, but are not limited to, visual inspection, the use of magnetometer devices, bag size limitations, bag inspections, and limited pat down searches. Discovery of a weapon at a screening checkpoint may require a law enforcement assessment of the situation.

Although this policy permits employees of CEI to carry firearms if they hold certain licenses, it does not authorize any employee to use any weapon in any official capacity. Any use of a weapon by a CEI employee is not authorized in the course and scope of employment, unless specifically authorized by Administration.

Questions concerning this policy should be directed to the CEI vice-president of finance and administration. However, General Counsel is the only CEI entity that will give official explanations of this policy. CEI is not bound by the statements of any employee outside of General Counsel regarding weapons policy.
